Question: What is a Signing Agent?
Answer:
A signing agent is a Notary who is specially trained to handle and notarize loan documents. For lenders, signing agents are the critical final link to complete the loan. A signing agent is hired as an independent contractor to ensure that real estate loan documents are executed by the borrower, notarized, and returned for processing on time. Completing this critical part of the loan process enables the loan to be funded.

The American Signing Agents Association, Inc. defines the signing agent as, “A signing agent is a trusted professional, usually a state commissioned notary public, that performs the closing ceremony for real estate transactions, mortgage loan transactions, legal process transactions and other similar transactions where an independent third part is requested. A signing agent should insure that they are disinterested in the transaction and have a mutual obligation to all parties to remain objective, neutral to any position, insure awareness of document contents by affiant and make a reasonable effort to prevent fraud and protect affiants from coercion.”

Signing Agents generally have five primary responsibilities:

  1. To coordinate and oversee the appointment at which loan documents are signed by a borrower

  2. To receive or reproduce documents for the signing appointment, and to deliver the documents to the appointment

  3. To ensure that the real estate loan documents are properly executed

  4. To ensure that the documents requiring notarization are properly notarized

  5. To return the documents for processing

Signing Agents adhere to The Notary Signing Agent Code of Conduct. 
This is because the Signing Agent plays a pivotal role in lending integrity to mortgage finance and real property transactions. The purpose of the (Code) is to enable Signing Agents to operate according to the highest standards of practice expected of professionals in the settlement services industry. Signing Agents are prohibited from giving legal advice or in any way explaining or interpreting the meaning of any terms or documents, and they are not permitted to prepare the documents, or alter them in any way. Any advice, explanation, or opinion can be considered unauthorized practice of law.
